SMS Campaign Terms & Conditions

Please read the following terms carefully before enrolling in our text message program. Your participation constitutes acceptance of these terms.

Program Description

Sheridan Capital operates an SMS text messaging program to deliver timely and relevant communications to enrolled customers and prospects. This program is provided as a convenience to help you stay informed about your financial accounts and appointments.

The program is administered in accordance with all applicable federal and state laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable guidelines issued by the Cellular Telecommunications Industry Association (CTIA). 

Consent & Enrollment

By enrolling in this program, you expressly consent to receive recurring automated text messages at the mobile telephone number you provided.

Your consent is not a condition for purchasing any product or service from us. Consent may be withdrawn at any time as described in the Opt-Out section.

You represent that you are the account holder or authorized user of the mobile number provided and that you have the authority to enroll that number in this program. 

Message Type

Enrolled participants may receive one or more of the following categories of text messages:

Transactional Alerts, including account activity notifications, balance alerts, payment confirmations, fraud alerts, transaction receipts, and other operational communications directly related to your account.

Appointment Reminders for scheduled meetings with financial advisors, loan consultations, account reviews, or other service appointments booked with us.

Security Notifications, including one-time passcodes (OTP), multi-factor authentication (MFA) codes, and login verification messages.

Regulatory Disclosures, including legally required or compliance-related notices mandated by applicable financial regulations. 

Message Frequency

Message frequency varies based on account activity, enrolled alerts, and active promotional campaigns. Transactional and security messages are event-driven and may occur more frequently depending on account activity.

We will make reasonable efforts to avoid sending messages during early morning or late evening hours, specifically before 8:00 AM or after 9:00 PM in your local time zone, in accordance with TCPA quiet hours requirements. 

Costs & Charges

We do not charge a fee for participation in this program. However, message and data rates may apply based on your wireless carrier plan. Standard SMS and data rates charged by your mobile carrier will apply to all messages sent and received.

We are not responsible for any charges imposed by your wireless carrier. Please consult your carrier’s pricing plan for details. This program is available on most major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, and US Cellular.

Carrier Notice: Msg & data rates may apply. 

Opt-Out

You may withdraw your consent and opt out of this program at any time using any of the following methods:

Reply STOP to any message you receive from us.

Send an email to [sms-support@sheridanfunds.com](mailto:sms-support@sheridanfunds.com).

Upon receipt of a valid opt-out request, we will send one final confirmation message and cease sending promotional text messages. Please note that opting out of promotional SMS does not affect transactional or legally required messages tied to your account, which we may continue to send as permitted by law. 

Re-enrollment

To re-enroll after opting out, text START or JOIN to re-enroll via sheridanfunds.com/sms. You will receive a new consent confirmation message. 

Eligibility

This program is available to residents of the United States who are 18 years of age or older and who hold a valid U.S. mobile telephone number capable of receiving SMS text messages.

Participation in certain message categories, such as account alerts and security notifications, may require an active account relationship with us. We reserve the right to determine eligibility at our sole discretion. 

Privacy & Data

Your mobile number and related information collected in connection with this program are governed by our Privacy Policy, which is incorporated by reference. We will not sell, rent, or share your mobile number with unaffiliated third parties for their own marketing purposes without your prior consent.

We will also not use your personal data for marketing or promotional purposes.

We may share your information with service providers who assist in operating this program, such as SMS platform providers, subject to appropriate confidentiality obligations. All data handling is conducted in accordance with applicable financial privacy laws, including the Gramm-Leach-Bliley Act (GLBA).

Your mobile number will be used solely for program communications and account-related purposes.

We maintain appropriate technical and organizational security measures to protect your data.

Regulatory Compliance

This program is operated in full compliance with applicable laws and regulations, including:

Telephone Consumer Protection Act (TCPA): We obtain proper prior express written consent before sending marketing messages and honor all opt-out requests promptly.

CTIA Short Code Monitoring Handbook: Our messaging practices comply with CTIA guidelines for commercial messaging programs.

Gramm-Leach-Bliley Act (GLBA): Customer financial information is protected in accordance with federal financial privacy standards.

State-Specific Laws: We comply with applicable state consumer protection and privacy laws, including those of California (CCPA/CPRA), New York, and other applicable jurisdictions.

FINRA / SEC Guidelines: Where applicable, all investment-related communications comply with applicable securities regulations. 

Limitation of Liability

Text messages are delivered via third-party wireless carriers and networks. We are not liable for delayed, undelivered, garbled, or misdirected messages due to factors outside our reasonable control, including carrier outages, network congestion, or technical failures.

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to your participation in this program, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to this program shall not exceed the greater of either the amount paid by you for participation in this program or one hundred U.S. dollars ($100.00). 

Modifications & Termination

We reserve the right to modify, suspend, or terminate this program at any time with or without notice. If we make material changes to these Terms and Conditions, we will notify enrolled participants via SMS prior to the changes taking effect where feasible.

Your continued participation in the program following notification of changes constitutes your acceptance of the revised Terms and Conditions. These Terms and Conditions supersede all prior agreements relating to the program.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with our standard Dispute Resolution Policy.
